Terms of service and privacy policy


Terms of Service

By commissioning Feefers Creepers Art/Fifi Intrieri (the artist) for art services, the client (you) agree to all terms and conditions stated within this document.

Section I ⁠— General

  1. All works done by the artist are NOT to be used as non-fungible token (NFT). Any non-compliance to this term will be met with legal action via DMCA.

  2. The artist reserves the right to refuse a commission for any reason without need for explanation. 

  3. Inappropriate/aggressive behavior of any kind will not be tolerated. Should this or a breach of the Terms of Service occur, the artist may stop or cancel the commission. 

  4. The client must read, understand, and agree to all the terms. By continuing with the commission and going forth with the payment, the client has agreed to the above terms.

Section II ⁠— Payment/Prices

  1. All prices are in USD. Trades will not be accepted in place of USD, unless stated otherwise by the artist.

  2. Prices are subject to change according to size, complexity, and/or detail of the piece at the discretion of the artist.

  3. Prices site-wide are also subject to change at any time at the discretion of the artist.

  4. Final prices stated by the artist are non-negotiable.

Section IV ⁠— Process/Communication

  1. The client must provide image references if available either via link in order form, or via email to the artist and/or clear and concise references/descriptions of the subject/character being commissioned in order to avoid confusion. 

  2. Quotes may be provided at the client’s request. Quotes do not necessarily represent the final price, but are only an estimate at the time of sending and can be changed at any point in the future at the artist’s discretion. 

  3. Clients may request changes during the sketching process. Changes applied after this check in may require an extra fee based on the nature or complexity of the change.

  4. Work in progress images will be sent to the client during the sketch stage for approval.

  5. Final commission piece will be sent via email provided to the artist by the client, or by request, a Google Drive link in order to receive the full quality image. 

  6. The platform for communication must be established in advance so that both the client and artist can have a reliable line of communication, whether it be over email, instant messaging, etc. 

  7. Due to unpredictable variations in each unique order, the artist does not work with explicit deadlines. Please allow up to 5 weeks for commission turnaround, unless otherwise stated by the artist, which could mean a further delay in delivery.

Section V ⁠— Rights

  1. The commissioned art may not be used for commercial purposes, redistributed or reproduced unless otherwise stated by the artist. The client may NOT make any profit off of the piece, which includes but is not limited to digital prints, physical items, etc. unless otherwise expressly permitted by the artist.

  2. Requests for use of artwork for advertising or merchandise may be discussed with the artist via email, and must be addressed before the art is delivered so that the artist may add a watermark to the piece intended to be displayed.

  3. The artist retains all rights to the piece of artwork itself, including the right to make any merchandise. This must be communicated with the client in advance and have the client’s full consent.

  4. Removing any artist watermarks is a violation of these terms.

  5. The artist retains the right to crop, edit, or alter the image for promotional use.

  6. The artist does not claim any rights to any intellectual property or the subject(s)/character(s) depicted in commissioned artwork.

  7. The client may not alter or edit the piece of artwork itself unless agreed upon by the artist.

  8. If permission has been obtained from the artist, the piece may be posted to their platforms of choice so long as full credit is given to the artist.

  9. The client may not claim the commissioned piece as their own work in any way, shape, or form.

  10. The commissioned artwork may not be resold.

  11. The artist is not responsible for providing the client with a physical object, print, merchandise, etc. of the artwork unless ordered as such.

  12. The client may print a copy of the commissioned artwork for personal use if provided with written consent by the artist. It may not be redistributed or sold in any way.

  13. If given express permission by the artist to use the commissioned piece for any advertising/merchandise, the client agrees to use a watermarked (small print artist name/info included) version of said artwork, and may pay an additional fee for the rights at the artists discretion.

  14. Artwork will only be watermarked if intended for any display other than personal use.

Section VI ⁠— Refund Policy

  1. If the client wishes for a refund before beginning any work, a full refund will be provided.

  2. If the client wishes for a refund after beginning any work, a percentage of the refund will be provided at the artist’s discretion based on how much work is complete. 

  3. If the client requests a refund after the commission is completed, no refund will be provided, as each work is unique to the buyer.

Privacy Policy

Data Collection Privacy Policies per data collection resources:

  • All personal data entered at checkout, (shipping/billing addresses, card/online payment information) is collected by SquareSpace, and/or Stripe, or PayPal, depending on which method of payment you choose.

  • The artist will see and have access to shipping addresses only, which will expressly be utilized for shipping. The information is collected at time of payment, and is stored in the commerce order forms, but will not be utilized unless ordering a physical product, in which case it will be used only for shipping purposes.

  • No customer entered contact information or personal data will be used for any purposes other than delivery of physical art, or communication between client and artist. No information will be sold, openly displayed, used for advertising or anything other than it’s intended purpose.

  • User data can be removed/deleted from commerce history by the artist if requested. (To request removal of personal data, email the artist at feeferscreepers@gmail.com) Client names and email addresses will be retained by the artist for legal reasons.

  • Manually entered user data remains in the commerce history log indefinitely unless requested to be removed by the artist. Client names and email addresses will be retained by the artist for legal reasons.

  • Financial data is not visible or accessible to the artist. All transactions are performed by the services available and chosen by the client at time of purchase, funds are then sent to the artist via the client’s chosen application upon approval.
